EPA Diesel Fuel Additive Regulation

OVERVIEW OF THE SITUATION

Over the last several weeks the entire diesel fuel additive industry has been aggressively working to address new labeling requirements for consumer diesel fuel additives that have been adopted by the U.S. Environmental Protection Agency (EPA).

This EPA regulation for diesel fuel additives went into effect on June 1, 2006 while the vast majority of the consumer diesel fuel additive industry was not even notified or aware of this requirement before May 1, 2006. Therefore, products remaining on store shelves or in retail inventory prior to June 1, 2006, are likely not appropriately labeled.

This regulation requires that all diesel fuel additives SOLD after June 1, 2006 to be labeled with one of two statements on the container depending on the sulfur content of the product.

(A) For those additives sold in containers for use by the ultimate consumer with a sulfur content not exceeding 15 ppm, the following statement applies:
"This diesel fuel additive complies with the federal low sulfur content requirements for use in diesel motor vehicles and nonroad engines."

(B) For those additives sold in containers for use by the ultimate consumer, with a sulfur content in excess of 15 ppm, the following statement applies:
"This diesel fuel additive does not comply with federal ultra-low sulfur content requirements for use in model year 2007 and newer diesel motor vehicles or model year 2011 and newer diesel nonroad equipment engines."

NOW WHAT NEEDS TO BE DONE?

All retail outlets, distributors, and distribution centers need to attach sticker labels to product currently in the stream of commerce.

Warren Distribution is currently labeling our product at the warehouse, but any product you may have ordered before June 1, 2006 will likely require a sticker label with one of the two aforementioned statements.

HOW DO I KNOW WHICH LABEL IS REQUIRED FOR EACH PRODUCT?

Warren Distribution has put together a list of products we sell that have been affected by this new regulation. We have also identified which label is required for each product through contact with our vendors. This list of products with the appropriate label type can be acquired by clicking here.

HOW DO I OBTAIN LABELS?

Warren Distribution has made these labels available for you on this website, by clicking on the link above, in the form of a Microsoft Word Document, in order for you to print them out from your own computer on standard Avery 5160 labels.

HOW AND WHERE DO I ATTACH THE STICKER LABELS?

Please attach the appropriate label to each individual product, in an area that is noticeable, but does not cover up any of the other labeling on the product.
